Please explain your issue is in as much detail as possible.
My Exarch(Vice-Royalty; multiple vice-royalty kingdoms) was able to form an empire even though I hold the Byzantine Empire Title. He was able to form the Carpathian Empire which in my game already has no De Jure territories since it drifted to the Byzantine Empire which I hold.
