2nd son inheriting while under Primogeniture

It's 1070 something. I am duke of Capua and married to Matilda of Tuscany. We have 3 sons and both realms are Primo. I get sick and pass on. Eldest son inherits my lands of Capua and I play as him.

Problem now is that I am no longer heir to Tuscany where Matilda still lives and rules.. My younger brother is. Don't know why, since both realms are Primo, the eldest son should be inheriting both realms.

If her liege has passed the illegal realm inheritance law and you are in a different realm, you will never inherit Tuscany. If you swear fealty to the HRE, you should then be able to inherit Tuscany.
