As it stands, what I think is happening (I haven't actually seen it) is that when you trade hostages, it's possible that one clan or the other can actually give the hostage land as if they were a regular courtier under certain (undetermined) circumstances.

When this happens, the courtier is broken in a sense and he creates a second clan, becoming head of his branch (which then acts as if it were a regular clan). However, when this happens, he remains heir of his original house...I noticed this happened when my 10 year old son was traded and I noticed in the character page that both he and his father had the clan-leader title. He was also listed as heir of the clan...but was neither a pretender nor available for selection in the clan page despite being auto-selected as the heir...and the problem was only solved when I declared war on this duplicate and annexed those two kokujin that the pseudo-pretender hostage-son had been gifted (I assume) by the other clan.

I think he was considered a vassal of them for the duration of the hostage treaty, but when released, he became his own clan instead of (properly) returning, with or without his lands, to his father's territory. Thus two clans with the same title, same mon, same colour, etc etc are created, and the only way to get rid of them is to declare war and forcibly subjugate them. THe game seems to think that they are of the same clan - and thus you cannot invite or join or anything...and marrying them back in is impossible for obvious reasons.
