I wouldn't feel safe about a TIE unless it was at LEAST 5 and 5, though whether this number should be higher or lower I guess would depend on the situation (number of players, how late in the day it is, etc.)

"At LEAST 5 and 5". At the time of your first post it was 5-5. Do I need to link you to the definition of "least" and "most" respectively? There's also the matter of the bit above, where Joeb points out how absurd it is to refuse to add a vote to a tie situation.
