When having a wife thats your spymaster (or a female ruler with her husband in any council post) you don't get the ½ spouse rank in said state attribute

Actually it looks realistic. Why would your spouse give you bonus twice?

nearly no matter what, it is (from State attributes PoV) better to have even a way worse counciler, than having your spouse on the post
Sounds right to me. If you name another councilor, you actually have 2 people giving you advice. If you name your wife, you only have one. Two people are typically going to be better than one.
That's working as designed. the result is quite similar if your regent is also a council member.
