The ToT is active until the Edict of Tolerance in the early 1600's. Before that you can conquer, without war, any catholic colony/tp that you have a ToT-core on.

...and when you take control of the province, you will gain ownership of it. If it has troops or a fort, then you must defeat those.

Build a level 1 fort. In the time it takes for the Spanish of Portugese to siege the fort (they rarely stick around to siege it...only just moving through the province) you can get troops there to kill them off.

I always try to. It's just in the meantime while the damn thing is being built up to 1000 pop that's the problem.

One thing i try to do is to get in a war with either Spain or Portugal pretty early on (I prefer Spain) and settle for all their coastal provinces with ports before the ToT sets in - blocks them off good, and usually serves as a goo start-off point to take Toledo later. Portugal is funner to let loose: earlier explorers mean they can get a decent (sea) map, which you can get through various means... so it's easier to explore after.

But that's just me...
