Someone finally asked Mitch and Jordan at Mechcon during the Q&A. HBS are not legally barred from using them. It's mostly a question of manpower and that they do not have enough personell to implement them. They will not show up in Urban Warfare, so expect something post-summer 2019 at the soonest. Everyone at HBS love the Unseen and they are aware that they promised them during the Kickstarter, they just had to postpone them due to the legal challenges. But Mitch just confirmed it, they will come.
I hope that finally clears things up.

I think the take-away for Harebrained Schemes and Mitch & co. is to be more transparent with the fans these days. Communication have been pretty lacking in 2018 compared to the previous years, and while PGI and CGL have all gone out of their way to at least implicitly give us clarification on the status of the Warhammer and the Unseen following the end of the legal case, HBS have unfortunately been dead silent about this. It would be nice with more transparency or community interaction like on the old forums, especially when it's a question that has come up again and again but without any form of response.
The only way we could hear about this was thanks to an audience member at Mech Con getting the microphone, and if not for that person, we probably still wouldn't have any confirmation. So just for future reference, it would be nice to have more transparency and response to what the community wants to know about in the future.
