As far as I understood, you can as Spain/Portugal attack any non-european province without having to declare war on the owner. However, in my Portugal game I just landed on Puerto Rico, a Spanish owned island, and nothing seems to happen. Does me being allied to them affect anything?
Because I seem to remember an incident where I was playing the dutch and was allied to Portugal, yet they still attacked and captured several of my brazilian provinces.
Or perhaps I need to have a shield on the province, the ones that are visible on the colonization map, not the political, that is.
