I have just started a game as the Habsburgs, and I have the misfortune of staying as Count while the HRE has the title of Duke of Upper Burgundy. Is there anyway to coax him into giving it to the rightful ruler (me)?

If your liege is higher than a Duke (and the emperor should qualify), isn't their a decision that lets you appeal to him for a Duchy title that you think should be yours? I remember seeing a decision like that as a French count, when my liege was the King and he had the Duchy title my County was part of.
If he gets more duchies he will be handing them out to avoid the demesne penalty, make sure he likes you better than all other counts in the duchy.
Usually the Emperor gains duchies elsewhere (Spain, Italy, Pommerania). Then he has to give some of them away. If he doesn't hold any land in UB and you're lucky you're the one who gets it

Doesn't really matter if he likes him more than the de jure counts of UB, the HRE has a weird fetish for giving a duchy to some far away Count. I was playing in Bavaria, and had a bunch of counts who all ended up becoming Dukes of different far off duchies. What made it worse is they weren't even given the de jure land they were just more or less titular dukes that were broken off from me.

I would imagine so, I am clueless though, I've only had one female ruler the entire time I've played sadly.
One thing that is confusing about petitioning your liege for a promotion is the *desires duchy of x condition... I want duchy x but for whatever reason my character is apparently happy to remain a count
You can also check your list of plots for one to forge a claim to the duchy, or your chancellor has a chance to forge a claim to it as well. Factions might be another way to get a hold of the title, or if crown authority is autonomous or limited, you could capture other counties in the duchy, wait for the emperor to get rid of the title, and usurp.
Most times I've tried to play the Habsburgs the emperor gets to the burgundy title before me and gives me some other duke title.
for some reason, the emperor has given me the duchy of sardinia 3 times out of the 3 that i played as habsburg within a year... why sardinia? i don't WANT saridnia damnit!
got that as the D'Ivreas (counts of Bourgogne) spent 10 years fighting different people for the title...
Well, once you get Upper Burgundy, Austria, or whatever you do want, you can give Sardinia to a son or brother.
If I was Kaiser I'd give the Hapsburgs Sardinia too, send them far far away where its harder to bother me with their ambitions.
