Sometimes AI rulers will allow this if they like you enough. I managed to get Loup Louping matrilineally betrothed to one of my Irish duke's daughters and there have been members of my dynasty holding land in Aquitaine and/or France ever since.
Apparently all strategos would do the same ... I gess it's a bug related to the emperor being the heir to the main title. They don't even take into account the "too high in the line of succession" modifier:
The AI sees that it's going to lose its primary title, so it allows all marriages. It doesn't consider the hereditary titles beneath the VR at all. Hard to believe this has never been fixed, probably existed since VR's were introduced.
AI with elective titles behave the same if their primary heir doesn't currently stand to inherit the primary title. I've seen Karl with elective W. Francia happily allow the heirs to all other kingdoms (under gavelkind) matri marry counts daughters.
You just have to consciously choose not to abuse this awkward AI behaviour.

I assume you mean the "Loup Louping" child in 769 start who is heir to the duchy of Aquitaine? He's fair game because he isn't in the court of duke Huanold.
