Galactic Custodian formed League Of non-Aligned in WOH but also became Satellite of Awakened Empire[3.4.3][9d15]

Just after 2 Fallen Empires awakened, the galactic community voted for a custodian. I voted in the AI option as I wanted to dethrone them later.
The War in heaven started, and the custodian and myself formed the League of Non-aligned powers.
The Team colour didn't look right and when I looked the Custodian was ALSO the Satellite of one of the Awakened Empires even though we chose to stand against them, we were all under the AI.
I kicked the custodian from the Federation then remembered I should have took the save first. However, i've attached a save during the War in Heaven clearly showing the custodian as a satellite when they shouldn't be able to be.
The custodian was initially the vassal on another empire. The one to it's left...I suspect that empire accepted the satellite request and took the custodian with them as Vassals becomes your vassals.
Steps to reproduce the issue.
Awaken 2 empires to trigger War in heaven
Nominate AI player as Custodian. AI was already the vassal of another AI Empire
Suspect Owning empire accepted vassalisation from Awakened Empire
League creation still formed
