Starting a Broken Shackles game with legacy human portraits can create two human species, one using legacy human portraits and the other using the new human portraits. Both species will have Sol III set as their home planet.
What I discovered while digging into the game files is that the pre_ftl_init_sol initializer in common/solar_system_initializers/pre_ftl_initializers.txt always creates a primitive Earth using the new human portraits, which might be related.
Steps to reproduce the issue.
Create or select an empire with the Broken Shackles origin. During empire creation set primary species portrait to legacy humans. Start the game.
