Currently, no.

I think it should be applied in all cases. No one was considered a legitimate Emperor if they didn't control the city (or were striving to.)

yeah there are some historical examples about this - I'm reading a book about Byzantium right now. But granted this might be valid for any kingdom or ducal title ...

what he said. And remember that when the city was taken noone claimed to be Byzantine emperor - there was empire of Nikae but it didnt restore until it was taken back
