which is kind of rediculous because nobody only starts to conscript more people if you really dont have anybody in reserve

Extreme measures are for extreme situations, you do not empty your factories of workers or conscript kids, elderly or disabled persons right from the start.

More modest then "Scraping the Barrel", yes. But still pretty substantial.

An additional thing to note is that China starts with very few factories and (if you have historical focus on or are just unlucky enough) is pretty much guaranteed to be only a year-and-a-half away from a major war with Japan in the 1936 start date. Good luck managing to unify China and building-up it's industry to take adequate enough advantage of it's manpower in that timeframe without cheats.

Total War is covered by the Economic Law - "Total Mobilization" 10% civilian factories required for consumer goods. Scrapping the Barrel as a Conscription Law would be much later. Late 1944 or even 1945, as the Soviets closed in on Berlin. http://www.hoi4wiki.com/Ideas

Total war is not exactly the same concept as total mobilisation.

But you are right, the Volkssturm was created (on paper) only in September 1944, its organisation began in october and first deployment in november.

If Japan conquers all of China, they didn´t get the whole 50-65%, but only 2-3% of the original manpower pool, thats a tiny difference.
Question - if I recruit those 2-3%, will those troops be of same quality as the ones receuited in core provinces? Or will they come with some morale penalties?

The country of origin of your troops is not tracked. I think that happens in Victoria, so you can have colonial units. But not in HOI.

Thats not entirely true, France (in 1939) conscripted thousands of skilled and needed military factory workers, the bosses of the workers demanded the return of the guys, because they needed them for the production of war materials, it took the french warminister three months to return the guys.
The other soldiers started a mutinity, as they believed that the workers are better treated, they even blow up one arsenal in Montlucon.
