Well, if you were looking for opinions...
It seems to me if a fleet has lost a battle and is steaming away from the enemy at full speed to avoid getting sunk they probably shouldn't be able to stop along the way and attack a passing convoy.
Or if they do it should give the winning fleet a chance to engage in battle with them again. I think this would be a very bad option unless there was a new naval command for fleeing ships to avoid doing this. Since I would not expect this new command to be put in I think Paradox should just prevent retreating fleets from engaging convoys.
(and I won't mention anything about slower ships being able to succesfully run away from faster ones that they lost the initial battle to in the first place)
Edit: In fact, I wonder if ships that are moving for any reason should be able to attack convoys, or if they should have to be stationed in a sea zone to attack any convoys moving through it. The AI seems to destroy my convoys by random chance when their fleets on world tour wander through a province with my transport fleet in it.
Sure a fleet could wander across a convoy by accident when moving through an area, but in reality they would only be likely to find and attack a convoy if they are on station and looking for a convoy to attack.
The drawback to this, of course is that the AI would hardly ever sink any convoys this way.
