Quality of smith items

I noticed that since last update paying the most to the smith doesn't give you level 3 items always. My question:

Is it random, and if so what are the probabilities, or does it depend on something like charcter's prestige?

Prestige. There's a third option that opens up if you have 2000 prestige going into it (vanilla change).

It must be higher than 2000 with the last update, because I was way above that

Ah, no. It seems that it is now strictly available to emperor-tier rulers. Change is a vanilla one, still.
