Chapter 37
Finale: The Trial Before the Noose
A trial was set up for Range in Madrid with several top Castillan officials in attendance.
Colonel Santiago would be the head of the military arrangement.
In Colonel Santiago’s office, the Colonel was going over several points of the trial with Major Marcos.
COLONEL SANTIAGO: I want you to know I’ve sent for the Polish Commanders
MAJOR MARCOS: But, if this man is
COLONEL SANTIAGO: I know…if he is Range we’ll have to let him go
MAJOR MARCOS: But, he murdered Captain Martinez.
COLONEL SANTIAGO: That’s matter of opinion…if this man is Range he killed Captain Martinez in self-defense. But, if this man proves not to be Range…we can hang him as a spy…then the world would be on our side in the matter…In any case we must be careful.
MAJOR MARCOS: But, Colonel!
COLONEL SANTIAGO: Listen to reason…We need to prudent in matters such as these…if he is Range…we don’t want the entire world to come against us…now do we?
Moments later the court convened.
Range was standing on a small podium in front of the bench where three Castillan the Colonel, the Major and another officer were ready to try the case
COLONEL SANTIAGO: The charge is murdering a superior officer. .. with certain extending circumstances. What is the accused plea?
RANGE: I was only defending myself.. .
The Colonel began to slam the gavel upon the bench.
RANGE: And, he wasn't my superior officer. ..
MAJOR MARCOS: oh, the audacity of the man.
COLONEL SANTIAGO: (beat) My dear man maybe you’re not acquainted with courtroom procedures…you have a barrister. He will enter your plea for you.
DEFENSE LAWYER: Not guilty.
RANGE: Like I was saying…I was being forced to join an army I didn't want to belong to. I'm Irish, or Scottish
MAJOR MARCOS: Stop this this instant.
RANGE: ...and should have something to say in the matter of what I join or not join.
COLONEL SANTIAGO: (beat) What is your name?
RANGE: If I knew I'd tell you ...
Miriam jumped up from her seat in the gallery ...
MIRIAM: Range ... tell them who you are!
COLONEL SANTIAGO: How did she get in here?
DEFENCE LAWYER: He's the man's wife Colonel.
COLONEL SANTIAGO: Bring her forward.
Miriam was then brought forward by an armed guard.
COLONEL SANTAGO: Do you know this man?
MIRIAM: Yes ... he’s Range, one of the military commanders of the Polish army.
MAJOR MARCOS: If this man is truly Range why does he not tell us his name…maybe it’s because he’s a spy?
MIRIAM: No, no…that’s not true…he’s not been able to remember his name ever since he took a blow on the back of his head.
A court officer approached the bench to whisper into the Colonel’s ear.
COLONEL SANTIAGO: (court officer) Allow them to enter…but, have them take seats various parts of the courtroom.
The court officer motions to allow the visitors to enter.
COLONEL SANTIAGO: (to Miriam) It has been made known to me that you are this man’s wife…is this true?
The commanders entered the room, taking seats in various parts of gallery seating area behind Range.
Miriam wanted to say yes.
MIRIAM: No…Range, everything I told was a lie…we were never married!
MAJOR MARCOS: Well, there goes all hope for this man…without her word…
The Colonel raised his hand to quiet the Major.
COLONEL SANTIAGO: You do know with your testimony you have doomed this man to death. Why did you do it?
MIRIAM: I hoped to shock Range back to his senses.
Silence was allowed to fall. Then, suddenly, Evin began to sing a familiar hymn… Familiar to someone from some future time and someone that knew Scottish Gaelic.
EVIN: (singing)
O Miorbhail grais' nach breagh'an ceol;
'S e lorg mi 's mi air chall,
Air seachdran dorch', gun neart, gun treoir
'S a dh'fhosgail suilean dall.
Range soon began to remember, singing low at first. But, his voice grew in strength as the hymn took hold.
RANGE AND EVIN: (singing)
'S e gras thug eolas dhomh air in'fheum;
'S e gras thug saors'is sith;
'S cha cheannaicheadh or a' chruinne-che
Chiad-Ia bha fios nam chridh'.
MAJOR MARCOS: Very entertaining.
COLONEL SANTIAGO: (amazed) Can I take it that you and the miss are the author of this hymn?
RANGE: No…me and my great-great-granddaughter Evin, don’t claim to have rights to the hymn if that’s what you mean. But, we’ve sung it from time to time.
GORSKI: Good to have you back Range.
RANGE: It’s nice to hear your voice Gorski
COLONEL SANTIAGO: Can you point out the other Polish commanders behind you.
RANGE: well, that’s my great-great granddaughter Evin and her husband Jurek, of course there Gorski…and, there’s Alina…
I think it’s safe to say that you are Range. Now, what to do with you…court adjourned…you’re free and please leave Castille immediately I change my mind.
The Colonel and the other officers stood up to leave.
RANGE: Oh, aren’t you forgetting something?
COLONEL SANTIAGO: (beat) What?
RANGE: My one-hundred soldiers…and let’s not forget the three sergeants their also mine.
Colonel: Take them and do with them as you will.
As Range and the other commanders began to leave, they sang Amazing Grace…the very song that Evin and Range sang in Scottish Gaelic a few moments before.
THE COMMANDERS:
Amazing grace how sweet the sound
That saved a wretch like me.
I once was lost, but now I'm found;
Was blind, but now I see.
COLONEL SANTIAGO: Remarkable man…and, a beautiful hymn.
DESERTION IS A CRIME AND MUST BE PUNISHED!
Range knew what he would ask the other commanders to do would not be easy. But, the insurrection of desertion had to be paid.
The Castellan government would not allow a Polish court Marshall in their country nor would France. The only alternative besides bringing the accused back to Poland was a trial and execution was held at sea.
Range did not want the ones to be executed to ever step foot on Polish soil again. So, the trial and execution was held at sea.
The trial was only a formality…all one hundred and their sergeants were found guilty of desertion in the face of the enemy…the penalty of which was death. But, Range did not want all of the accused to be hung…only two.
Strangely, he asked sergeants Grabowski and Zawadzki, along with Nowak to select ten men from the one-hundred deserters.
Nowak respectfully choose not to take part in the choosing of the condemned men…so he selected himself to be one of the ten.
Range: You’ll be the eleventh then.
The evil sergeants picked the other ten men carefully…troublemakers to their cause.
They then brought the men before Range…and, as Range stared at Grabowski and Zawadzki standing beside their choices and Nowak. Range then chose his words carefully as he addressed the other commanders.
RANGE: Standing before you are the men that have been tried and found guilty of desertion…from ALL THESE MEN STANDING BEFORE YOU CHOSE TWO TO BE HUNG for their crime.
In the captain’s chambers, Alina read the names out loud and commented on each man.
ALINA: (voice quivers) Nowak…he’s a brave man…honorable; Sawicki…the old man; Wieczorek…the partier ; Czerwinski…your friend; Kucharski…the cook…
GORSKI: All I can find wrong with the man was that he cooked very badly.
ALINA: Wisniewski…the planter of trees; Kowalczyk…the blacksmith; Wozniak…the cart pusher; Kwiatkowski…the little one; Zajac…
GORSKI: The rabbit.
MANDEK: He gets my vote.
ALINA: Stop it!
Alina stormed from the table in tears.
All eyes turned her way…understanding just how she felt.
RANGE: A lot has been said about me…but, there’s one thing no one can deny…I’m true to my word.
GORSKI: (beat) That brings us to Duda…the bad musician.
MANDEK: That makes eleven.
RANGE: Aren’t you forgetting the other two. (pause) There were thirteen men standing before us.
GORSKI: You did say all the men standing before us…
Alina then turned back in realization.
ALINA: Grabowski and Zawadzki get my vote!
She said, slamming her palm onto the table.
All the commanders said “Aye”.
RANGE: Then, it’s unanimous…(chuckles) I can wait to see their faces.
It was settled… Grabowski and Zawadki were hung a few moments later for the crime of desertion and leading others into desertion. Of the one hundred most were given a choice…they could either go to the new world or be hung if they ever stepped foot in Poland again. The others, the eleven were given an even better choice in Range’s mind at least.
RANGE: Gentlemen you are no longer in the Polish army…You can either go to the new world, or sign up and become new recruits of my personal regiments with a clean slate…no past army record.
All except Zajec chose to become a recruit in Range’s personal regiments. He actually didn’t have a choice in the matter Range personally placed Zajec on the next boat to the new world before the rabbit had a say in the matter. So, the other ten joined up as new recruits…and, remained friends with Range till their dying days.
