I really do not know why or when this change was made, but if i for example choose to take a purely red flag, primary colour red, secundary colour red... The Game gives me an Empire with a red rim but a black inside. It is the same with multiple colour combinations, especially when doublepicking a colour. I do not understand why this was made or exists in the first place, if i want my Empire to be a huge purely golden or red or turquoise mass on the map i should be allowed to have that. It is actually annoying me since it does not even seem to follow any logic of why it does that. It so often defaults to see-through or something dark inside of my Border. I put a file in as an example of what i mean, this Empire was created with primary and secondary colour being turquoise.

I tried to do this in early games too. I think there is SOME control over the color choices but no, definitely not any option. I had the impression it was programmed to give you at least one color of your choice flag colors whether border or the "filling". The AI might be designating the other empires colors first and then not allowing the same color twice? *shrug

I'm guessing the reason a player isn't allowed to choose the colors of their empire space is probably because if you were allowed to in Multiplayer, it would interfere. So, the game isn't meant for you to be able to choose this either way.

Honestly, then they should make a Multiplayer only rule for that, neither me nor the majority that play the game are Multiplayer People. It annoys me to no degree that they do that and it makes absolutely no sense that i have to look at an unpleasant black/see through Empire on the Map. And if you do Multiplayer and they all choose the same colour to troll then you play with the wrong people anyways.

Multiplayer, there could be a warning in the lobby that two or more players have the same colours.

Although, it's not like same colours is the end of the world, just more confusing.
I do believe you should be able to change your empire colours ingame for both yourself and AI vassals
