Some rulers historically did have mistresses or favorites who essentially acted as their right-hand men (or women) without having a real political position. This unofficial political influence could be translated into game terms in the same way the unofficial political influence of the spouse is translated.
The idea is a paramour (or favorite, or mistress, or whatever) mechanic, if it's possible to code. The paramour replaces the spouse on the council. Say your religion accepts male adultery, and you're a man. You may not be married to Countess Maria, but you're lovers so you can make her paramour. Or your religions accepts female adultery, and you're a woman. You can have a paramour too.
Also, it looks like CK3 has gay marriage hardcoded to not work. Unfortunate, but apparently in place to fix some bugs. They may or may not fix it and softcode it, who knows? Disappointing but understandable, especially for those of us excited by the prospect of gay marriage in certain total conversion mods like After the End.
