Your patriarch protects your kingdom's members from excommunication from outside. But shouldn't an emperor be able to excommunicate any members, if their patriarch is the emperor's vassal? The game mechanic won't allow it because one can not simply switch their religious head.
Edit: Actually moving the capital should be a way to change your religious head.
