New fort system not quite working as designed I feel

Senario
I am playing as Pommerania and I have just beaten up TO and taken some land from them.
I've just conquered Marienburg, Ermland, Kulm and Osterode. Marienburg and Osterode have forts.
In a previous war with them I've taken Danzig and Tuchel.
During our peace TO separatists have been growing in Tuchel. Now just before I take this new shiny peace deal the separatists have reached 90%.
I take the peace deal and start moving my troops back to my territory. Here is where I mess up, I notice that i've accumulated enough mil points to tech up and does so as well as switching to men at arms. I move across the border, the beginning of the new month comes and TO separatists rise in my country in Ermland and Marienburg(fort here). I now find my self in combat with separatists in Ermland with <50% moral units. So I decide that I need to retreat. But lo and behold, I cannot retreat due to hostile forts blocking my way. Apparently my own forts whom I still have full control over I cannot shatter retreat through. Please fix this cause it just took the fun out of this campaign. Since after the battle which I lost my army could not move out of the province and was completely wiped.

was it for sure the cause of the fort? was it just to early to retreat?

that said a shattered retreat would probably send you back to your capital...

as wiz said there are "no circumstances" when this happens, ergo you must be making it up.
or, dear wiz, there is a problem..........

looks like you were engaged where they were seiging, while they were also seiging a fort that would, if you were in hostile lands, be the only place you could get to there. could that cause it? or is it because you tried to retreat through the fort zoc?

Yes I had the presence of mind to pause when I could not get away after the "to early to retreat" icon in the battle screen went away. didn't have the presence of mind to screenshot the tool tip telling me it was cause of hostile forts.

And shouldn't me army get a shattered retreat towards safer lands after they lost the battle due to 0 moral? So why were they unable to leave Ermland?

Could it have something to do with being black flagged when leaving the TO territory?

Had a similar thing happen as England, though I didn't notice anything about forts blocking my way. Fought in Artois against Burgundy, couldn't even retreat to calais and my units proceeded to get stackwiped.
