HBS case did not involve the key unseens. The HBS case involved other mechs. So I think they can still fire at them though I could be wrong.

My read is that if the settlement agreement allows for PGI to continue using its models of the various unseen mechs as non-infringing, then PGI will likely be free to license out those models (and representations thereof) to Catalyst and HBS. If the design is concluded as non-infringing by the alleged rights-holder (HG), then they would generally not have any grounds to bring a complaint against other folks who are using that design.

Not having seen the settlement agreement, this isn't locked in stone or anything. Personal setting: cautiously optimistic (and maybe trying to figure out which Warhammer variant I'd want to field).

To be fair, this was a bit of a gamble on HBS's part. They knew going into this that DisgruntledSilver was lurking in the background, and COULD mess things up.

With HBS's exit from the lawsuit early in order to make the release date, they put the fate of the Unseen for their games in PGI's hands.

As others have said, depending on what this settlement looks like, PGI may be allowed to license their designs without issue. In which case HBS should be free to go through with their original KS goals.

But it all depends on how strong PGI's position was when entering into negotiations, and how much of that leverage they were able to apply.

Official statement from PGI. Looks like the Unseen are good to go.

Based on what's in that statement, we have NO idea how this may or may not affect HBS's ability to put the mechs into question into the game.

For the time being, I refuse to let any sort of hope fester.

Until HBS puts out a statement, we do not know how, or even if, this affects them. Right now I would not expect the unseen to be added to HBS's Battletech. Not unless HBS puts out a statement saying that the unseen are being added.

If HBS is cautious, they might wait until Judge Zilly signs the dismissal before they issue a statement. If they issue one at all, that is.
