Piranaha's second motion for summary judgement as to Harmony's lack of standing, docket no 87, is RENOTED to April 20, 2018.

Any idea what "RENOTED" means in this context? Google is proving less than helpful finding a definition

It means "to have the clerk of the court put it on the court's calendar."

As in: "I noted my summary judgment motion for hearing on March 30, 2009." That means: "I had the clerk of the court put a hearing regarding my summary judgment motion on the court's calendar for March 30, 2009."

Normally you note matter for hearing by submitting a written request to the court and other parties identifying the time of hearing and the matter to be heard.

They can petition the court to reopen under FRCP 60. Their defaulting was risky, but a win here provides cause to reopen as HG would not have had the right to sue in the first place. Honestly it is possible the default will minimize legal cost to catalyst and provide them with a win based on PGI's resources.

Yeah, it was a strange position for Catalyst to take. They may have been banking on PGI, possibly even pooled resources. If so it's a risky play but kind of clever. I wouldn't have had the stones, not considering how often HG has weasled a win out of these proceedings.

The HBS case has been dismissed that is all.

Huh, okay I assumed the dismissal meant HG was not allowed to chase HBS on this and they were free to go ahead and use them, shame maybe I got excited for nothing.

The case against HBS didn't involve the unseen, it was Atlas Shadowhawk and Locust.
none of which HG alleges to own the rights to, they just claimed them as derivative works. It was clear that would go nowhere so both parties agreed to a dismissal

I wouldn't hold my breath on the unseen. HBS is playing it safe. The good news is most of the unseen have already been rendered and were in the pre-release beta. They probably haven't done most of the animations. Still deployment should be relatively easy once they decide to pull the trigger. In success...

I chuckle a little every time someone asks this question wondering if this is time it will lead to someone saying something about the question be answered on almost every page of the last like 9+ pages. I am waiting on the explosion

Well, we haven't heard about anything that went down yesterday, so I'm going to guess that their motion for summary judgement was denied. I'd love to be proven wrong on that one, but in a court case, it would have to have the most absolute bit of evidence on your side, HG may have just squeezed by with enough evidence that they have merit to continue.

I hope you're wrong, but I suspect you may be right. Regardless, it's probably still too early to tell.

I would not assume yet that summary judgement has not been granted. I understand submissions were made and oral argument presented on Friday, but it would I imagine be fairly usual for an actual ruling one way or other to take days or weeks before it is made.

If it takes too long, it may be rendered on the 4 May deadline that HG was given regarding Does 1-10.

You mean In Medias Res? They failed to respond to the lawsuit and had a default judgement passed against them last year.
