Marshall becomes new vassal

I went to war against some non-christians and when I took one province my, to this point in the game, best marshall became a count (and my vassal) in that province, and no more marshall (no happy, surrender, reload).

What I would like to know is;

what decides what is to happen with my newest conquest, sometimes "I" get it as a demesne, sometimes a new vassal is created.

I posted about this some time ago. If the marshal leads the army in non-christian provs he get's the land. You have to make sure the king is in command of the army!
