Because they enable it. Think of it as you consciously giving a child keys to a car, and then it ends up in some giant wreck. You may not have been driving but you hold ultimate responsibility.
That is, Paradox may not be making the content, but it is enabling it and providing a platform, therefore is culpable to a certain degree.
Also lets not turn this into another thread about Communism please and thanks. We all have our political views, this is a question of mere reality/practicality, not a political commentary.

They got into trouble because the assets were part of the base game, a nazi mod made by a single user would not get them in trouble because their assets would not be part of the base game. It would be completely a 3rd party mod. Hot Coffee was not.

so long as you follow the lines and go no further than what is being used for HOI then you should be good, I would though advise using the censored version of hitler as Germany has access to the same steam works and there could a legal issue there

I'd actually be a bit surprised if you can't *actually* do Space Nazis (short of actual swastikas) in the vanilla game. The ethics and government type is there, and I'd be surprised if you can't manage a red field, white circle and black cross logo. German name lists are certainly no problem, and may well be in because Germany is a major market. You can play as Humans from Sol if you wish.

Someone is still bound to make a Nazi mod despite what the rules say, if they can not put it up on workshop they will release a manual version on the internet. Also, considering that a good chunk of the player base is not German.

Of course it happens but that doesn't mean the industry should be more careful and gladly it isn't otherwise video games wouldn't be sold and mods wouldn't exist but the industry and the shops know they need the sales. Well not everywhere in the case of Australia but since people buy more and more online, such behaviour is incredibly stupid. The whole coffee shop affair was stupid from all involved party, which includes Rockstar who didn't even try to defend themselves.
Regarding the topic here:
Swastikas aren't illegal in Germany. They exist in movies everywhere but many (mostly Germans) think video games would need to be accepted as art but that's not it, the problem was always that not a single company ever used the paragraph that protects movies, pictures or books, they always recoiled and censored beforehand. This way no one knows if it's illegal in video games or not, because no judge had ever to decide. So is making such a mod illegal somehow? No one knows and probably not but no one will care too, even though Paradox of course has to make dispositions but it's safe just publishing it elsewhere.

Acknowledged. I will make my mod using an iron cross as emblem and won't include a Hitler's portrait just to be on the safe side. Maybe I can modify the default human clothing to better suit the theme of the mod?

This is IMO why Nazi Germany was far worse than the Soviet Union, but I want to make it clear that I am certainty not trying to claim that the USSR is without guilt or somehow benevolent.
True, but OP is also wondering about the Paradox forums, and it should be fine there if OP doesn't include any Swastikas.

Germany is very stright when it comes to Nazi-Stuff like flags, uniforms or symbols. Sometimes it seems ridiculous how extreme their laws on that matter are, but if you are born and raised there (or in austria), you not only learn to accept it, but to actually unterstand the deeper purpose of it. And while I (as a austrian) could of course tolerate a picture of Hitler or the 'real' Nazi-Flag in a historical game (like HoI), I can also unterstand everyone who thinks that this is something they not want to see. After all, I am actually quite happy that our countries have so harsh laws on their nazi-past.
