Just realized that the issue when you start a new colony and you are at the colony-cap (5/5) you get the penalty in EC-production for being inefficient even though the cap not being broken, since the colony isn't done yet, and even if you throw a colony into a sector so you end up at 4/5 you still get the penalty. In fact, the penalty remains in place until you do a save-then-load.
This bug was reported so long ago I'm a bit surprised it's still in there. It's quite crippling for a large empire to get a 10% "permanent" penalty to EC-production if you forget to sector a system before you colonize a new one.
