Enemy army is orphaned can't siege or be attacked

As Rome I'm at war with Carthage and they are not the war leader. They have an army on the Italian penisular that can't siege my territory or be attacked by me becuase it says it is orphaned.
I don't have this problem where I have sieged their ally in Sardinia and have taken the war target. As far as I know from finding out if they were involved in another war and are just making there way to friendly territory. Their behaviour at first didn't suggest that. By the time I had moved a couple of armies in range to attack it's when I noticed they had the orphaned icon on their army. All abit strange can't work out the logic of it. Bugged army or orphaned army taking the really long way home. Carthage wasn't involved in any other wars that I knew about. Thought it might be a possible bug so posting it here
Steps to reproduce the issue.
I declared war on war target which was ally of Carthage.Sieged war target down defeating the Carthage ally army.
I noticed a Carthginian army on central Italian penisular. I didn't notice if this was landed by boat there or had landed south and had walked up to this point.
