Unless it changed in HF you can usurp it as any religion, you just need to control enough of it and then make sure the current holder has no holdings left in the de jure empire. You can't create it without being orthodox though.

I'm not sure what would win between imperial and open succession, or if they added a block to usurping it just to stop that from being an issue.

You have the Kingdom of "Rum" for the sunni/turkish, you can create it or begin during the timespan of it's existence.
Then you can form from it a custom empire like you would do with any other kingdom, it don't have much flavour, but it's always better than just a Muslim Byzantium.

It is the same as any other title. Conclave is your best friend if you want to (more reliably) acquire a claim on it. Buy a favor and marry their princess. Your heir will have a weak claim to press.

You can also choose to raid the emperor's desmense until you capture his daughter. The primary problem as a Muslim is you do not have concubinage, so you cannot abduct the princess to your court. You might be able to educate her to your religion, and the emperor might then allow you to marry since AI doesn't care so much about infidel marriages in his court. Or princess might join your court after you release her (post conversion.) That's a long term gamble though.

Or you can do as suggested above, push the emperor entirely out of his own de jure territory and then usurp.

you cannot usurp it EVEN if you control entire region since only orthodox allowed to take it :/ as I understand atleast
here is requirements for byzantium empire:
Roman Empire does not exist. Latin empire does not exist. Must be Orthodox or Hellenic/Hellenic Reformed.
but if it is not correct allright then.
I mean if its only to create title not usurp it
but then it means if byzantium fall I will lack a proper empire title I can usurp without custom empire

so as turks I need to invade byzantium and then either
A)convert to orthodox then become muslim
B)Marry byzantine claimant and usurp throne

meanwhile I also fighting aganist crusades :p (wich actually I got time until 900 years and catholism is weak at start but still)

Because Ottoman empire did actually usurp byzantine empire title and called themselves heir of rome after fall of constantinapol.
wich they did by marriage...

This. Only orthodox and hellenics can create byzantium, but anyone can usurp it if you hold the de jure land. I know I did, as catholic.

One thing to note is that if you're relying on the wiki for who can and cannot create certain titles, most of the time those are AI-only restrictions. The player can still take those titles normally.

Also note that you can't usurp a title from someone of a different religion who still owns de jure land under the title. So, usurping the Byzantine Empire can take a while. I personally prefer destroying the title outright and creating a new empire I prefer, but that's me.

A bit OT, but the same is true for those annoying kingdoms that have de jure territory but are difficult/impossible for most people to create (eg. Hungary and Jerusalem). However, these kingdoms have an additional option - if you win a GHW/Jihad/Crusade then the kingdom title is created automatically at the end of the war.

Create title is NOT the same as Usurp or Claim.

There are no such restrictions when it comes to usurping or claiming special titles. For example I regularly claim the titular Empire of Seljuk a few generations after his conquests, as I marry his daughters and acquire their claims to the empire.

Once the title exists, you can usurp it/claim it like any normal title.
