Okay the question isnt really how to create it i know i need to own all the provinces and have cores on them. The thing is the year is 1438. i Have Vassalized all the provinces needed but the thing is if i annex them wont it give me unlawful territory which will make my infamy rise after each year how can i survive that? :)

Yes, it will. Smarter might be to force them in personal unions, so that you'll get cores when you inherit them. The side effect of this is that it may take a very long time before you actually inherit them.

Wish for missions that will give you cores. Or what Luitzen said, PU's. You can force PU's when you Royal marriage them, then claim throne (only when they have a weak heir), then go to war with the proper casus belli.

If you annex a vassal and release it again immediately, they should get a new ruling dynasty, so they start out with 20 legitimacy. Wait for ~ 4 years, the legitimacy should still be < 50, so you can use a spy to forge a claim on their throne. Once the truce (from releasing a vassal) ends, cancel vassalization and declare war in order to force a PU.

devastate the owners of all the provinces you need and dont interfere when denmark/poland/TO goes to war with them-with luck they will conquer all of northern germany, which you can then conquer with cores, using the imperial ban CB.

Annex them diplomatically, and suck up the infamy.
I formed Germany as Frankfurt (A republic, no PU spam cheating) by 1550 sucking up unlawful territory as I went. It is not hard. The game is over once you form Germany.
Never went over 8 infamy.

I used a combination of all 3-random luck PU (no forced ones just married every HRE minor that showed up on the list), diplo-annex+eating infamy drain for unlawful territory, and reconquest/conquest in my Bavaria game. Formed Germany in early 1600s but was already the more or less hereditary HRE at that point anyway. Early game is just follow your missions, keep the provinces you want/need and give away/sell any extra to whichever 2-bit nothing has a core on it. I kept some shadow wars going the entire time I had unlawful territory if I wasn't emporer-no need to give Boh or Aus the imperial liberation CB against me.

When I went to form Germany as Bavaria I used a combination of PU's and diplo-annexations. I basically concentrated on the missions and on those states that I needed to own in order to form Germany, so I was never in that much trouble when it came to infamy (I could take a hit or two for unlawful territory). I was lucky in that I got the territories I needed early, either in a PU or through vassalisation, so I was able to stagger my annexations in order to keep the infamy under wraps.

when i want to unite germany i always end up by pushing that "dismantle HRE" bouton for saving magistrates and/or infamy, it also helps for the crowded interface ...
well that's said it is often one of themost exciting and hardest wars to be able to push that bouton for wich my country prepares for 20+ years carefully so it migth not be the more strateforward aproche ...

I was thinking several times of dismantling the HRE just to clear up those gazillion opm/2pms. Otherwise I was always kinda scared of the huge manpower and micromanagement I would need to do that ^^

Especially because 95%+ of the time Super Austria/Bohemia/Burgundy had the imperial crown...

Yeah, much less hassle to just become hereditary HRE through vassalizing the electors. Another possibility is vassalize a couple and ally with as many others as you can so you only have to hit one or two plus the HRE to dismantle it.
