I believe the flags are done for the community. So yeah anyone can use them. But if you're using them in a mod or AAR the creators would like some sort of recognition. If you're still doubtfull ask the creator of the flag if you're allowed to use it. You probably can but it's nicer to ask

if you are contempt with a all black eagle coat of arms on the flag there is a flag and shield in the 1914 mod. Or somewhere on this thread i think...

No, they aren't if you don't make Naval nation And it's not good idea.

genrally i use a combination of the ordinary flag for the shield and the battleflag for the wavy flag. Unfortunately, there is only one lfag for units, and that includes both land and sea units, so perhaps come up with a compromise between the army and navy flag?
alternately, you could put naval flags into units icons, like with SKIF.
