This simple change could solve problem of giving Soviet Union or China tons of free divisions (also the French might be able to regroup south of Somme as they did in 1940), they would be able to defended themselves but not go on offensive. Militia divisions are too weak individually but when there are too many of them they become exploit since they can be used for massive offensive and if your China casualties are not a problem.
Many divisions were static simply because they lacked vehicles or horses to tow their heavy weapons and got moved around by rail (or in Chinese case they belong to local warlords who didn't want to give them up) but they were rarely destroyed in battle just because they couldn't retreat, like normal infantry divisions they would abandon their heavy equipment even small arms and retreat on foot (in chaos), retreated divisions would often be unfit for another battle unless given proper time to reorganized and reequip so we can simulate this by division going to redeployment and losing 10-20% of its strength, if redeployed immediately to the front it would have 0 organization so it would be smashed again and again until destroyed but this happens to all divisions so I hope AI isn't that stupid.
Only problem might be if AI doesn't disband useless divisions once it goes on the offensive but that might be solved by giving AI command to upgrade them to regular infantry?
This would also make Garrison divisions good rear guard which could be sacrificed over and over while main army retreats.
P.S.
Of course problem might be with surrounded divisions... not sure how that works, maybe have then check if they are in supply and if retreat is possible? That should prevent surrounded divisions or divisions on islands to escape destruction.
This would finally give a feeling of fight masses of enemy divisions without actual risk of being overstretched and unable to defended long front lines from masses of militia/infantry divisions.
