Unfair? I dunno. It's certainly biased (review by Mr. Unreal Tournament), but to call it slander?
Though I agree some of the things he said about HOI are undeserved, when you release a game into the market you understand that there's those who will like your game and those that won't.
Besides, there's no need to jump through the 100 different levels of legal loopholes to get no where.
Organizations like that usually have every orifice covered legally anyways.
