Started as the Count of Pfalz in the HRE, was given the entire Duchy of Ferrara in Italy by the Emperor.

The Pope immediately started to berate me (-30 opinion penalty) for having free investiture. I apparently have no means to change this, though. It's under crown law. And now the HRE has gone to papal investiture, I can no longer appoint clerical replacements, and the Pope still has the opinion penalty.

Do I literally have to go independent and form the Kingdom of Italy to escape this?

I believe it's WAD, even though it may seem strange. You get the benefits of Free Investiture - you can appoint bishops, so you also pay the price - lowered relations. That being said methinks there should be Free Investiture and Papal Investiture factions.

Edit: I somehow missed the point of the second issue (Papal Investiture with the penalty still applied). It's almost certainly a bug.
On a plus side I think that if you form the Kingdom of Italy you may get your own crown laws even without becoming independent - that's what happened to me a few patches ago.

No, that's a glitch I've had as well. The opinion penalty depends on your de jure kingdom law (depending on the location of your capital), but what you can actually do is defined by the laws set by your de facto king/emperor.

I definitely count this as a bug--the only laws that should apply to actual vassals are the de facto ruler's laws. The de jure realm laws should only apply when the count/duke is independent (or the de jure ruler is also the de facto ruler, of course).

This should also apply to elective monarchies. I find it really strange that the duke of Flanders gets a vote for the HRE when he is the king of France's vassal.

Historically, being an elector in the Holy Roman Empire was connected to holding the right title. You get your vote if you hold the title, regardless of allegiance--perhaps that's what the game is trying to simulate? Of course, the system is wrong anyway, as not every duke in the HRE got to vote by far. (I don't know how they did this in other elective monarchies.)
