I think that demanding an oversea province must be free from the fort occupation.
It's really not fun going to occupy st. helena with a 20k stack in late game because portugal decided to fortify it for really no reason.
This is a valid example for every colonial nation or overseas territory.

I rather believe that American colonial wars were largely about conquering enemy forts. Aside from them, vast areas were scarcely inhabited and virtually defenseless, but in practice this lack of defensiveness counted for both sides - easily got, easily lost. The forts were what mattered.

Well, it may vary significantly. So let's stick to the St.Helene example. AI Portugal considered it important enough to build a fort there. We can discuss whether such a decision is wise or another of many AI stupidities. But you are a human. Do you value St.Helene enough to siege it even at high cost? If yes, then AI perhaps was not that stupid to build a fort there.
And if you think St.Helene is almost worthless (as it were in real life for most part of the history), then you don't have to bother and can leave the Portuguese hold it.

I don't think I understand; are you saying that you shouldn't have to occupy a fort on a different landmass to be able to demand provinces on this one, or are you saying you shouldn't have to do that to demand provinces on that one (where the fort is)?

I think you ought to need to occupy at least one of (a province on that landmass) and (their capital) to ask for provinces on that landmass. You shouldn't have to occupy a fort in, for example, america to ask for land in Iberia though.
