It is there. Just search Crusader Kings II. It will not be shown in the quick search results but in full search it will. Its also listed under the coming soon tab in Steam.

I am not a lawyer, but that would suggest no modifying the core files of the game, rather than the data files. So, provided you don't change the important bits you should be safe, especially if the mod is free, and only includes the changed data files.
