I think we are assuming claims in Victoria will work like CB's in EU. I hope a claim is an option, so the Grand Duchy of Freedonia can assert a claim on California, and doing so might ease a Freedonian invasion in game terms, but the act of asserting the claim would antagonize others with claims on California, and to some extent the rest of the world.
This would allow for "built-in" claims (such as those mentioned), which would exist at the start of whatever scenario and therefore wouldn't cause a penalty, while allowing any advantages. But aside from that, I hope claims are not hard-coded.
