Please explain your issue is in as much detail as possible.
In any game that starts post-769, Saxony will be marked as an Inactive Kingdom, meaning that nobody can form it. It can be formed in Iron Century by Thankmar winning his rebellion against Otto, this rebellion also forms the Kingdom of Swabia, the Kingdom of Franconia, and the Kingdom of Thuringia. Currently, the latter 3 Kingdoms are not marked as inactive at game start, despite Franconia and Swabia having their own decision-based Kingdoms formable in their Grand Duchies under the HRE.

Bug has existed in the game since Iron Century release.

Steps to reproduce the issue.
Step 1. Begin a 1066 game as Duke Rudolf of Swabia
Step 2. Create a second duchy
Step 3. Creation of Titular Kingdom of Swabia is available

Over two years later, this issue still has not been fixed. It can have significant gameplay consequences in the 1066 start for example, where I have seen Swabia, Thuringia, and Franconia created by their respective AI dukes in the same game, destabilizing the HRE and gaining independence from it. I don't expect any more content for CK2, but it would be nice for Paradox to do a final pass for the numerous known bugs which exist in the game to this day.
