Please explain your issue is in as much detail as possible.
As Charlemagne, I invited a Byzantine prince to my court and made him an antipope, and simultaneously pressed both of those claims. As expected, this resulted in a theocratic Byzantine Empire, with the Pope as Emperor. I then swore fealty, and found that the Empire was still using the Imperial Elective succession law from Holy Fury, not the theocratic/papal succession as it should be, even though the government type was shown as "Theocracy". When the Pope died, I inherited the Byzantine Empire and the Papacy, which is now playable, and the government type has reverted to Imperial. The game can be saved and loaded normally, and the Papacy title follows the new laws, so it can be passed to dynasstic heirs like any other title.

Actually kind of annoying; I was planning to play as a loyal vassal to the Pope-Emperor, but no, I have to do the heavy lifting.

Steps to reproduce the issue.
In the save provided, simply kill the reigning Pope.

Manually:

Start as a king or below; I used Charlemagne. Find an unlanded claimant to the Byzantine Empire, give them a temple, and make him an antipope. Press his claim to the ERE and the Papacy, then, swear fealty to him. Arrange to have yourself elected as the next Byzantine Emperor. When the Pope/Emperor dies, you will inherit all of his titles.
