Please explain your issue is in as much detail as possible.
As the Roman Emperor, when going to the usurp a kingdom-tier title, the tooltip says that I'm unable to usurp the title due to being a Merchant Republic or Patrician - instead of referencing my Imperial government type.

Steps to reproduce the issue.
1. Conquer the lands of a de-jure kingdom
2. Go to the Usurp Kingdom button of the corresponding kingdom
3. Observe the wrong tooltip being displayed

That is an excellent question. The only way I can imagine is somehow having the kingdom title destroyed and then re-creating it. But that's not really a viable way against larger enemies, like the Tulunids and Abbasids in my case.

Well you can revoke the title if he is your vassal, but in my case the guy is sitting in Bagdhad, thats not even close. I dont know exactly how his ancestor jumped to anatolia, but they did a great holy war or an invasion. So either I carve my way to him until I can attack him directly or I try to push a claim for a claimant I guess. I landed one family member and now I try to kill the family until I can push her claim for the caliphate. I also noticed it is not possible to transfer vassals of duke level under other Exarchs, which complicates the issue, as having too many vassals can be really really bad.

If you're planning to play as byzantine/roman, I heartily recommend turning on the game rule where kingdom titles will eventually be destroyed if they're held by someone who has none of the de-jure land. Otherwise, yeah, you can run up against someone hoarding a couple kingdoms on the other side of europe.

Yeah. When was this change made to the Imperial government type? Or has it always been like that? Because if it was changed recently I do feel like that title destruction rule should be on as default, compared to the current situation where it's off.

But too late to change the rules now, I'll have to see how far I can get without it.
