Very Subtle Combat Bug

I think there is a very subtle combat bug, involving the maximum number of defending units in command (i.e. not penalized for being beyond the maximum for the battle commander).

Situation: The defender (AI - Yugoslavia) has 4 defending units, commanded by a Lt General (3 units) and a Major General (1 unit) (in that order); this gives the stack a maximum command capacity of 3, this is listed correctly as 4/3. The 4th unit correctly has its effectivity reduced, most of the time.

Occasionally during the combat the effectivity of the 4th unit "jumps up" by about 100% (95% during the day, but the number changes slightly from day to day), when I attack it with an Air Unit.

It seems the stack is gaining the value of having an HQ; it seems the 4th unit no longer exceeds the combat capacity. The displayed command value does not change, it is still listed as 4/3. The effect is the same if I use an air unit with an "Air Marshall" or a "Lt General"; I was suspicious the defending stack was gaining a benefit from the attack air units commander?

IIRC command penalties are not applied when defending against air attack. Was this higher efficiency shown in the air vs land battle or in the land vs land battle?

The effectivity of the 4th unit is the same in both ground and air combat. I did a little more testing.

After loading a saved game, the effectivity of the 4th unit is lowered (IIRC) in ground combat. When an air unit attacks, the effectivity of the 4th ground unit is no longer effected by IIRC (or something) in ground combat, as long as the air unit is attacking. When the air unit leaves, the effectivity of the 4th unit in ground combat returns to normal.

Note: Sometimes the 1st attacking air unit is done "correctly", the effectivity in ground combat of the 4th unit does not change. But when a 2nd attacking air unit arrives the effectivity in ground combat always seems to change.
