Non-embargoed merchants are getting competed away first
For example, I as Portugal, own Malacca. I get tired of Mataram, China, and Brunei trying to monopolize my COT, so I embargo them.
MTR is at 5, BEI at 5, CHI at 2, POR is at 5, and others controlling the remaining 3.
I lose a couple of levels down to 3. I send some more merchants to get back up to 5. This goes on for 10 years. I check the merchants levels, and my friendly embargoed merchants are at:
MTR is at 5, BEI at 5, CHI at 2
I've seen this in several different cases.
To recreate start a game with a country with a highly competive COT. Embargo someone. Note the level of the embargoed country's trade. Now, send merchants. Unless their is no one else to compete away, any 'compete away' results will not (or almost never? not sure) compete away those embargoed merchants.
