There are a lot of flags in the updated tree of Yugoslavia, and the flag of Bosnia and Herzegovina is absolutely inappropriate there. It is modern, although there were a lot of flags before it.

Some flags aren't accurate, as happen with Germany. There're some nice mods (ironman compatible) that adds historical flags.
Right now they're using for German Reich the Kriegsmarine naval flag because PDX officially doesn't allow the historical one, which can be understandable.
There are a number of reasons they use non-accurate national flags, but 2 are most important IIRC.
1) Legal (Local) laws. In some countries they are trying to sell the game you just simply can't use the historical national flag*. Germany is the most prominent example of this.
2) Individuality. They need to have 4 easily discernable flags for each nation (1 for each ideology, so you can see from a glance that a country has changed...this is the same reason for most of the fantasy country names (Emu Empire anyone?)), not only that, they have to also be unique enough from other countries (which is why the Chinese Warlords have flags at all instead of using the official Chinese Flag they should be using.)
* At least until recently, and I don't think Paradox wants to test the waters after launch to see if they can get away with it now...maybe for HOI5 when they are sure it can be used in a game.

They didn't follow that rule completely in LaR though, if France brings Napoleon back, the flag remains the same. But it's accurate because even when France turned from republic into empire they still used the same tricolor flag.
No, the Kriegsmarine used the German war flag as its ensign and the national flag as its jack. The in-game vanilla German flag is a fictional design based on the German war flag.
