Yeah, I think Threatened is the key here (did the devs mention this?). Picardy joined and I wasn't allied with them but Savoy won't join because I am allied to them. Time to break that alliance and see if things change. Also, do AI nations change their capital to their default one anymore? I was trying to get some to join by changing it to a province in the HRE.

When your current capital gets taken it moves to their highest dev province,

war 1, take capital, core it , add it to HRE, and then return it to him.
War 2, take his new capital, it will move his capital back to his old one, and then autojoin the HRE.
The other option is to make a province bordering him very high development, make sure it's in the HRE, and then sell it to him. Then his capital will move to that province after the first war.

Easiest way to watch this is when you're eating someone like the ottomans and take their capital every war.
