It's an interesting idea, and if the winning side accepts the peace treaty they will only get the territories that they selected at "justify war goal". But in practice, I think this option will be irrelevant for most players. People play to annex the whole country.

It depends, I get tired if I have to make the USA capitulate to win a game ... and we all know that making the USA capitulate, at least it takes 2 years and at least 200 atomic bombs.
