Reported something similar here, which seems to have been ignored as it got no reply. It was almost fixed in 2.2.0.5.
However, the game is still giving my capital away. Game was started in 2.2.0.5 under the apparent Gavelkind fix.
I created a custom Kingdom out of the Duchy of Austria. The Kingdom of Bavaria still exists as I didn't own 100% of the land - I was given no de jure territory.
I understand that Gavelkind likes to focus on the 'de jure' capital but this is not possible with the introduction of custom Kingdoms. I didn't get any de jure territory since Bavaria still existed, and even if it didn't, the game doesn't seem to assign a 'de jure' capital area anyway.
It seems to have only been applied to Elective Gavelkind (haven't used elective since 2.2.0.5 though, so someone needs to confirm this). Alternatively, it seems everything was undone with the 2.2.0.5 fix to Gavelkind.
EDIT: Did a test: Used console commands to forcefully change to Elective Gavelkind and something similar happens. It gives me the de jure capital duchy and de jure capital county of Bavaria... not the 'current' capital as said in the quote. The confusing part is I don't even own the kingdom of Bavaria. Basically, nothing's working as intended.
My capital (Österreich) is being given away and my heir receives a single poorly upgraded county (Ödenburg):
The result (it also decided to let me keep the Kingdom of Italy despite having 2 other brothers):
The county I received is a bit of a joke county. It's almost entirely owned by the Teutonic Order:

It would also be nice if the weight given to Empire/Kingdom titles wasn't so heavy. A kingdom + a single terrible county is far, far worse than 4 highly upgraded counties which supplies almost 10k troops, etc... It usually makes the second in line have far greater power within the realm than the actual king and heir himself.
I would even pay for a Gavelkind DLC at this moment in time, because it's very frustrating! I just want to get on playing a nice game of CK2 instead of having to switch to Elective ASAP.
