ALL my titles are Elective but, upon creation, the HRE is Gavelkind. I can only assume this is because the game fails to realize that my primary title's succession law (which is only titular) is set to elective. Even if this isn't the cause, the old HRE event from pre-Charlemagne would automatically make it elective.

I have a custom Kingdom of Austria as my primary title but no de jure lands because Bavaria existed when I created it.
I've since gained enough land and also re-created the Kingdom of Bavaria to create the HRE (because I need a Kingdom title within either Francia/Germania/Hispania or Britannia). Also, if I didn't have Bavaria, the Kingdom of Austria wouldn't be added de jure to the HRE since it's titular. If it DID have de jure lands, I wouldn't have been able to create the HRE since since it wouldn't belong to the Empire of Germania but to 'no empire' instead (black land on the empire map mode). So, trying to create the HRE with custom kingdoms is a bit of a headache.
Also, an unrelated 'bug' shortly after: My landed daughter-in-law (who is my vassal), allowed my ONLY son and heir to join a Holy Order. That's a big no-no. I'm her liege and an Emperor, just because she's landed and married to my heir gives doesn't give her any rights to let him become a celibate good-for-nothing. I had to reload and give him a landed title to avoid this silliness.
