I didn't see anything in the patch notes, so not sure if this was intentional or a bug introduced from fixing unlawful imperial territory issues from 1.23, but Austria was demanding unlawful imperial territory from me even though I was allied to them and had 200 relations. I was playing as Saxony and Austria sent the demand after every single war. While the relations hit wasn't enough to end our alliance, the constant unrest, prestige, and legitimacy penalties were annoying. This takes away the only real benefit from allying the Emperor as an HRE member who is not on the edge of the empire since you can't call them into internal wars. I guess it prevents them from declaring war on you for the territory, but I would rather just ally Poland or France to discourage Austria from coming after me.

Well, the tradeoff is still: give the land back or risk my wrath, i.e. losing the alliance. With enough trust and good enough relations, you can still keep the alliance.

I really hope this is WAD.
Now, if the emperor also got the penalty automatically for holding unlawful HRE territory himself (there is no plausible reason why the emperor should get a free pass on violating imperial law), things would be quite shiny.

I played both a Florence and Provence(I joined the empire) game in 1.23 where I allied Austria and ate up HRE provinces while never getting unlawful imperial territory. I have played an HRE game every patch and I honestly don't remember this happening before. If it is WAD, that's fine, I will just adjust my strategies for the fututre. Just want to know if it was intentional or if there will be a bug fix.

In 1.23 the Emperor never demanded territory because of a bug. Its in the 1.24 patch notes:

- Fixed estimation of relative strength of alliances (Fixes Demand Unlawful Territory, Threaten War and various AI strategy issues)

And the wiki, updated from 1.21 actually says:

Being allied with positive opinion to the emperor makes it less likely that he will demand unlawful territory from a nation.

So its possibly been around longer. I'm trying to find an exacting patch note for it but I'm positive its been in the game for months and months.

I believe it was added a few patches ago and is WAD, as it should be. If you were really Austria’s friend, you wouldn’t annex their subjects :(

I'm trying to remember the title of the thread I created, but can't seem to find it. I do remember creating it though. There was a patch note somewhere that stated the AI emperor would be more aggressive in demanding unlawful territory, this seems to have included allies. I don't think Paradox has confirmed this to be WAD or broken though. So it would be nice to get somebody to confirm this here.

actually player emperor should consider removing alliance if his ally is not giving unlawful terrority back to dow him for it later... so if its intented makes sense

Ironically, that itself is a player abuse of mechanics. :)

According to the 1.14 patch notes, https://eu4.paradoxwikis.com/Patch_1.14 :
  • The Emperor can now demand unlawful territory from countries that are at war, as long as they are not at war with the Emperor.

And this works fine if the player is the Emperor ; but is unfortunately affected by the same issue that makes the AI reluctant to do all sorts of diplomatic actions when they, or the target, are at war.
The most obvious example is Royal Marriage offers. If a ruler dies during wartime, and the marriage relationship ends, the AI won't react immediately. But as soon as a peace is signed, you can bet that within a month, you'll get Alerts popping up for marriage proposals.

The Emperor can now demand unlawful territory from countries that are at war, as long as they are not at war with the Emperor.

From memory that is one of those things that AI just never does. Unless they changed that as well when they changed it so that AI Emperor will demand unlawful from allies.

Playing as Holland with 1.24, I had to choose between France and Bohemia (the emperor) in a War against Burgundy. Since I choose France, Bohemia broke the alliance with me. After some years I declared war on Utrecht but Bohemia did't get any liberation CB on me. Why?

Of course. OP was willing to abuse one mechanic so I suggested a different exploit to work around it.

Yeah, if I was playing a nation that I couldn't get Austria to ally, I would use the coring at war method to get around unlawful imperial territory. Unfortunately, you get more AE/higher dip cost of taking provinces from allies and AE is a huge barrier to expansion early on. If you can ally Austria and just take provinces from your war target, it helps mitigate the early coalitions.
