So this is my 10th or so attempt at creating the Roman Empire (mostly RP it so none of the power gamer tricks). Unfortunatly I get distracted by my OCD, and have started taking over Bulgaria to get my dejure territory. I have just taken the last de jury county of the kingdom of Bulgaria. They still hold the kingdom, but not a single de jury county or duchy title.
I go to usurp the title, and the tool tip says “Merchant Republics or Patricians cannot usurp kingdom titles.”

Does the Byzantine Empire (or imperial system) really count as an MR?
The top title has never changed hands, started in the earliest start and kept the title each succession. I own no city titles. And I’m very confused.
 
No, they're not.
It's just that before Roman Imperial Government was introduced, Merchant Republics were the only playable governments that couldn't usurp kingdoms (neither could theocracies, but those were unplayable).
And tooltip wasn't updated since then.
