I think you have to kick Harald's ass before. Is the norwegian king occupying any of harold's province?
Does Harald have any land still occupied? Since 1.05, some of these 3-way battles get a little bit jacked up. The problems typically come against rebelling lords, but I'm not sure that's your case. Don't know for sure how that war works; haven't played it yet.
THe norwegian's didn't own any land. I forced them out and had all about 4-5 provinces occupied.

I found out the reason the button is greyed out and I can't click on it is because it's already selected.
